Settlement (6-Figure)

The Charges

Jared Hagood was able to secure a large six-figure settlement against an apartment complex for a traumatic brain injury his client suffered. In 2014, the plaintiff was visiting his ex-wife at her apartment when he slipped and fell, hitting his head on concrete, and became rapidly unconscious after walking on a dangerous slick non-slip resistant handicap access ramp.

The Result

Two weeks after the incident, the complex received a work order proposal to repaint the property’s handicap ramps with a “skip-resistant additive”—“a product used to create slip[-resistant on wet, sealed concrete… micronized polypropylenes are manufactured using special equipment to provide a unique texturing agent… the rounded shape of the additive will provide optimum abrasion resistance, gloss control and will be less abrasive when compared to silico texturing agents.” In the lawsuit, the plaintiff alleged that the apartment complex (i.e. the property owner) owed plaintiff, an invitee, a duty of ordinary care to keep the premises in a reasonably safe condition which required the property owner to perform reasonable inspections of the premises to discover latent defects, protect invitees, like plaintiff, from unreasonable risks of harm on the premises of which the owner knows or has reason to know, and eliminate or warn in regard to the risks. After months of depositions and litigation, the parties were able to reach a high six-figure settlement for plaintiff, who was still under the care of a neurologist for the head injuries he suffered as a result of the fall.

Settlement (Negligent Activity)

The Charges

Jared Hagood was able to obtain a substantial settlement on behalf of his client that was injured as the result of negligent activity. In 2012, the plaintiff went to the defendant’s property, his friend at the time, for a friendly visit. The friend, however, begged plaintiff to cut some tree limbs on the defendant’s property that had been damaged from a recent windstorm. The plaintiff obliged and the defendant obtained the materials but failed to give plaintiff a safety harness which is designed to keep a person from falling out of a tree.

The Result

The plaintiff fell and suffered numerous injuries including a fractured wrist, a contused testicle, multiple bruises, reflex symptomatic disorder (RSD) and a laceration to his forehead caused by coming into contact with the defendant’s chainsaw. After years of litigation and multiple trial settings, the property owner’s insurance carrier finally decided to settle for a substantial amount.
